Terms and Conditions

We do our best NOT to limit our Travellers in their activities while staying at villa colibrí MX. We have tried to ensure that nothing contained in our Terms and Conditions is unexpectedly prohibitive and that what is prohibitive just amounts to basic respect and/or common sense. We do reserve the right to change these Terms and Conditions at anytime.

Definitions
The Property is villa colibrí MX in its entirety. The Rental Unit is the individual apartment(s) referred to in the Booking Agreement. The Rental Unit may also be the Property if all apartments are rented at once. The Booking Agreement is any arrangement to rent the Rental Unit made between the Traveller and the Owner and includes all of the Terms and Conditions described on this page. The Traveller is the person entering into any Booking Agreement. The Co-Traveller is any person that will share the Rental Unit with the Traveller. A Guest is any person invited temporarily onto the Property by the Traveller or Co-Traveller.

The Property
The Property contains a total of four (4) private apartments (Eloisa, Berilo, Rufo and Canelo) as well as the common elements. The Property may be rented in its entirety (Villa Colibrí) or in part by renting individual apartment(s). The common elements of the Property are shared equally at all times by the occupiers of the apartments. Entry to the Property may be denied at any time to any person not designated as the Traveller or a Co-Traveller. Entry to the Property may be denied at any time to any Guest.

The Traveller
The Traveller will be the occupier of the Rental Unit during the term of the Booking Agreement and must be at least twenty-on (21) years of age. The Traveller will be solely responsible for the Rental Unit and may not transfer their obligations under the Booking Agreement to any other person.

The Traveller will provide to the Owner the name of any Co-Traveller in advance of arriving at the Property. Co-Travellers must be at least eighteen (18) years of age and are limited in number by the maximum occupancy policies of the Property. Children (under the age of eighteen (18) years) of the Traveller or of a Co-Traveller are permitted to be designated as Co-Travellers. Co-Travellers will enjoy the same benefits as the Traveller.

The Owner
The Owner will ensure that the Property is kept in a good state of repair and cleanliness during the term of the Booking Agreement. The Owner will ensure that the Staff attend to the needs of the Traveller so long as the request is lawful and not unreasonable. Any repairs and/or staffing issues will be dealt with by the Owner in a timely and professional manner.

Guests
The number of permitted Guests is limited to two (2) Guests per apartment to a maximum of eight (8) Guests on the Property at any given time. Guests may use the common elements of the Property. At no time will a Guest be left unaccompanied anywhere on the Property.

Maximum Occupancy
Maximum occupancy of the Property is limited to twenty (20) persons.

Maximum Overnight Occupancy
Maximum overnight (from 11:59PM until 6:00AM) occupancy of the Property is limited to twelve (12) persons. Further, maximum overnight occupancy of any apartment is limited to two (2) persons (Traveller, Co-Traveller and/or Guests) per bedroom.

Events
Gatherings with more than eight (8) Guests on the Property will constitute an event and permission from the Owner for all events on the Property must be granted prior to the event. Additional fees, terms and conditions may apply to any event.

Service Providers
We ask that you use our preferred service providers for any commercial service that will take place on the Property. The use of other service providers on the Property is strictly prohibited without prior written consent from the Owner.

Security Deposit
The security deposit is required to protect against loss and/or damage. The security deposit is required to ensure that the Property is left in a reasonable condition of cleanliness, and in the same condition of repair as upon arrival. Any excessive cleaning, loss or damage to the Property, or debts or charges incurred may be itemized and deducted from the security deposit. If there is no excessive cleaning, loss, damage or debts or charges incurred caused during the term, a full refund of the security deposit will be made to the Traveller no later than seven (7) days after the date of departure.

Cancellation Policy
We encourage the use of trip cancellation insurance. Our cancellation policy is graduated and the most applicable refund will be applied to any cancellation.

• Travellers who cancel within 48 hours of a booking will receive a 100% refund.
• Travellers who cancel at least 90 days before the check-in date will receive a 75% refund.
• Travellers who cancel at least 60 days before the check-in date will receive a 50% refund.
• Travellers who cancel at least 30 days before the check-in date will receive a 25% refund.
• Travellers who cancel less than 30 days before the check-in date will receive a 0% refund.
If the Owner’s performance of any of their obligations in this agreement is prevented by any matter not within the Owner’s reasonable control, then the Owners may terminate this agreement by way of written notice to the Traveller. Should this be required due to no fault of the Traveller, any payments and/or deposits shall be refunded, without interest or deduction within seven (7) days of the written notice.

Note that all refunds are less any fees or service charges incurred by the Owner.

Rules
The Traveller, Co-Traveller and Guests will abide by the following rules.

1. The Traveller, Co-Travellers and Guests are required to act in a responsible manner at all times, and to act with respect towards other Travellers, Co-Travellers, Guests, the Owner, the Staff and the neighbours of the Property.

2. Activities that are illegal or unlawful (including but not limited to the use of illicit drugs and/or excessive noise) are prohibited and may result in the immediate eviction of the Traveller, Co-Travellers and/or Guests, without refund or compensation for any unused portion of the Booking Agreement.

3. Smoking is prohibited on the Property except in the bar area. Regardless, please respect any persons requests not to smoke.

4. Pets are prohibited on the Property.

5. Glass objects (drinking glasses, plates, etc.) are prohibited in the pool area. Supplies of non-breakable glassware, plates, etc. are provided in each apartment.

6. Under no circumstances may furniture or other household items be moved between apartments or common areas without prior consent from the Owner.

The Booking Agreement Legalese
All references made to times and dates in the Booking Agreement will be deemed to reflect Puerto Vallarta, Jalisco, Mexico times and dates. A Booking Agreement does not replace or void any further obligations imposed on both the Owner and the Traveller by virtue of local, state and federal laws and regulations. The laws of the State of Jalisco, Mexico shall govern the validity, performance and enforcement of a Booking Agreement and any legal disputes arising from this agreement will remain within the jurisdiction of the State of Jalisco, Mexico.

Liability
The Owner shall not be responsible, or liable for any accident, loss, damage, injury, death or inconvenience arising from the Traveller’s or Co-Traveller’s or Guest’s stay on the Property. The Owner does not accept liability for any loss or damage caused by weather conditions, riot, strikes, theft, sickness or any other such cause beyond their control.
